In the Indian Christian Marriage Act, 1872 the term "Indian Christians" includes the Christian descendants of natives of India converted to Christianity. Which means any person following the christian religion although he has not been baptised is a Christian for the purposes of the Act.
Persons by whom marriages may be performed in India according to the following norms
By any person who has received episcopal ordination, provided that the marriage be performed according to the rules, rites, ceremonies and customs of the Church of which he is a Minister;
By any Clergyman of the Church of Scotland, provided that such marriage be solemnized according to the rules, rites, ceremonies and customs of the Church of Scotland;
By any Minister of Religion licensed under this Act to solemnize marriages;
By, or in the presence of, a Marriage Registrar appointed under this Act;
By any person licensed under this Act to grant certificates of marriage between Indian Christians.
The certificate of marriage may be granted by the State Government to any Indian Christian.
As a part of this act, marriage between minors is allowed in Christian community. Though, this is not valid as far as Indian Christians are concerned. But in case of Christian Marriage Act, a procedure of marriage between minors is available under Roman Catholic Church and is solemnized by the minister of to the Church. However, the marriage is null and void on the ground that the consent of the girl`s parents is not taken. When either of the person is a minor, and the Minister is not satisfied that the consent of the concerned parties, in that case certificate of the marriage is not granted.
In case of Indian Christians, the age of the man intending to be married shall not be under twenty-one years, and the age of the woman intending to be married shall not be under eighteen years and neither of the persons intending to be married shall have a wife or husband still living; Just like any marriage in India, Christian Marriage too has to be registered with the Marriage Registrar in the city where either party has been residing for one year or more.
As we notice, though there are cultural differences among each community in India to perform their special norms and rites in marriage ceremonies, there are certain common attributes abiding to every community under the Laws and Acts in India.
